2. Acceptance of Terms

By browsing our website, placing an order, or engaging with BLACK in any capacity you confirm that you have read, understood, and agree to these Terms and Conditions alongside our:

3. Products

All BLACK rings are handcrafted and made to order. Each design is produced in a strictly limited batch of five units and is never remade once the batch is complete. Product descriptions, images, and specifications on our website are as accurate as possible. Minor variations in finish, texture, and form are inherent characteristics of the sand casting process and constitute the nature of the product rather than a defect.

We reserve the right to discontinue any design, modify our product range, or update pricing at any time without notice. Price changes do not affect orders already confirmed and paid.

4. Ordering

By placing an order with BLACK you are making an offer to purchase a product subject to these Terms and Conditions. We reserve the right to accept or decline any order at our discretion. An order is confirmed only when payment is received in full and you receive a confirmation from us.

For made to order and pre-order products, confirmation of your order does not guarantee immediate commencement of production. Production begins once full payment is received and your ring size is confirmed in accordance with our Made to Order and Ring Sizing policies.

We reserve the right to cancel any order at any time prior to dispatch. In the event of cancellation by BLACK you will be offered a full refund or store credit at your discretion.

5. Pricing and Payment

All prices are displayed in Australian Dollars (AUD) and include GST where applicable. We reserve the right to change pricing at any time. Price changes will not affect confirmed orders.

We accept the following payment methods:

  • Credit and debit card via Squarespace Payments

  • Afterpay

  • PayPal

  • Any additional payment methods made available at checkout

Payment must be received in full before production begins on standard orders. For eligible custom pieces a 100% deposit is required upfront with the remaining balance due before production commences, as outlined in our Deposits and Cancellations Policy.

BLACK RUSH PTY LTD is not responsible for any fees, charges, or currency conversions applied by your financial institution or payment provider.

6. Intellectual Property

All content on the BLACK website and associated platforms including but not limited to:

  • Ring designs, moulds, and finished pieces

  • Photography and videography

  • Brand name, logo, and visual identity

  • Written content, copy, and descriptions

  • Social media content

is the exclusive intellectual property of BLACK RUSH PTY LTD and is protected under Australian and international copyright and intellectual property law.

You may not reproduce, copy, distribute, modify, publish, or commercially exploit any BLACK intellectual property without prior written consent from BLACK RUSH PTY LTD. This includes but is not limited to photographing BLACK designs for the purpose of reproduction, replication, or commercial use.

Any unauthorised use of BLACK intellectual property will be pursued to the fullest extent of the law.

7. Limited Batch Policy

Each BLACK design is produced in a strictly limited batch of five units. Once five units of a design are sold that design is permanently retired and will not be reproduced under any circumstances. Availability is live and accurate on our website at all times. BLACK RUSH PTY LTD makes no guarantee of availability of any specific design at any time.

8. Limitation of Liability

To the maximum extent permitted by Australian law, BLACK RUSH PTY LTD will not be liable for:

  • Any indirect, incidental, special, or consequential loss or damage

  • Loss of profit, revenue, data, or goodwill

  • Damage caused by misuse, neglect, or failure to follow care instructions

  • Loss or damage caused by third party service providers including Australia Post

  • Any loss arising from reliance on information on our website

Our total liability to you in connection with any order will not exceed the total amount paid by you for that order.

Nothing in these Terms and Conditions excludes or limits any rights you have under the Australian Consumer Law that cannot be excluded or limited by agreement.

10. Shipping and Delivery

Shipping and delivery terms are outlined in full in our Shipping and Fulfilment Policy which forms part of these Terms and Conditions. BLACK RUSH PTY LTD is not responsible for delays, loss, or damage caused by Australia Post or any third party carrier once your order has been dispatched, subject to the insurance provisions outlined in our Shipping Policy.

11. Refunds and Returns

Our refund and returns terms are outlined in full in our Refund and Returns Policy which forms part of these Terms and Conditions.

12. Privacy

We collect and handle your personal information in accordance with our Privacy Policy which forms part of these Terms and Conditions and complies with the Australian Privacy Act 1988.

REFUND & RETURNS POLICY

Our Position

All BLACK rings are made to order, handcrafted individually, and sold as final. We do not offer refunds or returns based on change of mind, sizing issues confirmed after production, or subjective preference. Please read our Ring Sizing Policy and Made to Order Policy before purchasing.

Eligibility for Store Credit

Store credit may be issued in the following circumstances:

  • Cancellation before production begins

  • Order cancelled by BLACK for any reason

  • Pre-order falling outside the 8 week production window

  • Structural failure covered under our lifetime guarantee — subject to physical return and assessment

Store credit is issued to the full value of your original purchase unless otherwise stated and is redeemable against any available BLACK design.

Transit Damage

All BLACK shipments are insured to the full value of your order. If your ring arrives damaged in transit you must notify us within 30 days of receiving your order.

To lodge a transit damage claim:

  • Provide photographic evidence of the damage and all original packaging

  • Retain all packaging and the ring — do not dispose of anything

Each transit damage claim is assessed individually. Where damage is covered by our shipping insurance we will work with Australia Post to resolve your claim. Resolution may include store credit, replacement where possible, or insurance payout depending on the outcome of the claim.

BLACK is not responsible for transit damage where signature on delivery was waived or redirected by the customer.

Craftsmanship and Manufacturing Defects

BLACK rings are handcrafted and finished to the highest standard. Minor variations in texture, finish, and form are inherent characteristics of the sand casting process and are not defects.

Where a ring has a genuine manufacturing defect you may have rights under the Australian Consumer Law. Contact us at [email] within 30 days of receiving your order with photographic evidence and we will assess your claim accordingly.

Return Process

Where a return is required under this policy the following applies:

  • We will confirm whether your return is eligible before anything is sent back

  • The physical ring must be returned to our address in its original condition and packaging before any credit or resolution is issued

  • Return postage costs are the responsibility of the customer except where BLACK has made an error or the item has a confirmed manufacturing defect

  • We recommend using tracked and insured postage for all returns — BLACK is not responsible for items lost or damaged in return transit

Non-Returnable Situations

The following are not eligible for return, refund, or store credit under any circumstances:

  • Change of mind

  • Sizing issues where the correct size was confirmed by the customer prior to production

  • Surface wear, scratches, or patina acquired through normal wearing

  • Damage caused by impact, chemicals, or misuse

  • Lost or stolen rings

  • Rings returned without prior authorisation from BLACK

Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in this policy limits or excludes these rights.

SHIPPING & FULFILMENT POLICY

Dispatch

All BLACK rings are made to order. Dispatch occurs once your ring is complete and quality checked. Production timeframes are outlined in our Made to Order & Pre-Order Policy — estimated completion is 2–8 weeks from the date production begins.

You will receive a dispatch notification with tracking information the day your order is sent. We dispatch from New South Wales, Australia via Australia Post.

Shipping Options

We offer two shipping options at checkout:

Standard Shipping — calculated at checkout based on location Express Shipping — calculated at checkout based on location

We recommend express shipping for time sensitive orders. Production timeframe remains the same regardless of shipping method selected — shipping speed applies from dispatch only.

Free Shipping

Free standard shipping is available on orders over $[threshold]. This will be confirmed at checkout.

Signature on Delivery

All BLACK orders require a signature on delivery as standard. We will not dispatch to PO boxes or addresses where signature on delivery cannot be fulfilled. If you are unavailable at time of delivery Australia Post will leave a card for collection at your nearest post office.

We do not authorise authority to leave under any circumstances. A ring that cost $1,500 and will never be made again does not get left on a doorstep.

Insurance

All BLACK shipments are insured to the full value of your order. In the rare event of loss or damage in transit we will work with Australia Post to resolve your claim. Please retain all packaging and documentation if your order arrives damaged as this will be required for any insurance claim.

Tracking

Every BLACK order includes tracking. Your tracking number will be provided in your dispatch notification. Use it. Know where your ring is.

Delivery Timeframes

Once dispatched, estimated delivery timeframes via Australia Post are:

  • Metropolitan areas: 2–5 business days standard, 1–3 business days express

  • Regional areas: 3–7 business days standard, 2–4 business days express

These are Australia Post estimates and are not guaranteed. BLACK is not responsible for delays caused by Australia Post once your order has been dispatched.

Packaging

Your BLACK ring will arrive in branded packaging befitting the object inside. We take the unboxing as seriously as the making. Every order includes a care card and certificate of authenticity confirming your piece number within the batch.

Address Accuracy

You are responsible for providing a complete and accurate delivery address at checkout. If an order is returned to us due to an incorrect address, redelivery will be charged at the standard shipping rate.

MADE TO ORDER & PRE-ORDER POLICY

Every BLACK Ring Is Made to Order

Nothing at BLACK is made in advance and held in a warehouse. Every ring is made for the person who ordered it, after they order it. This is not a limitation — it is the point. Your ring does not exist until you claim it.

Production begins once full payment is received and your ring size is confirmed. Estimated completion is 2–8 weeks from that point depending on current schedule and complexity.

Dispatch Notification

You will receive a notification when your ring is dispatched. We do not currently provide production updates during the making process. When it is ready, you will know.

Pre-Orders

Upcoming BLACK designs are occasionally made available for pre-order before production begins. Pre-orders require full payment at the time of purchase.

Pre-orders are subject to the same 2–8 week production window from the date production begins — not the date of purchase. If your order falls outside the 8 week window from production commencement, you will be offered either a full refund or a 50% store credit towards a future purchase at your discretion.

Availability — First In, Best Dressed

Each BLACK design is produced in a batch of five. Once all five positions are claimed the design closes immediately and permanently. We do not accept payment beyond five units per design under any circumstances.

Pre-orders are not a guarantee of position — your position is only confirmed once payment is received. If a design reaches five confirmed payments before your order is processed, your payment will not be taken and you will be notified that the design is closed.

Never Remade

Once a batch of five sells out, that design is retired. It will not be restocked, re-released, or remade under any circumstances. Availability is live and accurate at all times on our website.

RING SIZING POLICY

BLACK — Australia

Complimentary Ring Sizer

Before production begins on your BLACK ring, we dispatch a complimentary physical ring sizer to your Australian address at no cost. This ensures an accurate fit before a single hour of work is invested in your piece.

Your ring sizer will be sent once your order or deposit is confirmed. Production does not begin until your size is received and locked in.

Locking In Your Size

Once you return your size to us, it is final. This is the size your ring will be made to. Take your time with the sizer - wear it at different times of day as finger size can fluctuate with temperature and activity. We recommend sizing in the evening when fingers are at their largest.

Why We Cannot Resize

BLACK rings are sand cast and hand finished. Resizing after production requires cutting the band and rejoining with solder - a process that compromises the structural integrity of the piece and creates a weak point that risks breakage over time.

We will not resize. Not because we can’t. Because we refuse to weaken something built to last a lifetime.

If a ring does not fit due to an incorrectly confirmed size, we are unable to offer a replacement, refund, or store credit. The responsibility of confirming the correct size rests entirely with the customer - which is why we give you every tool to get it right before we begin.

Sizing Standard

All BLACK rings are sized to the Australian standard. Your complimentary sizer reflects this scale.

Custom Pieces

For custom orders, the same sizing process applies. A ring sizer is dispatched with your deposit confirmation. Production begins only after your size and final payment are received.

Australian Consumer Law

DEPOSITS & CANCELLATIONS POLICY

BLACK — Australia

Payment

All standard BLACK rings require full payment at the time of purchase. Production does not begin until payment is confirmed and your ring size has been received.

For custom pieces, a 50% deposit is required to secure your position. Your complimentary ring sizer will be dispatched upon receipt of deposit. Once your size is confirmed, the remaining 50% is charged before production begins.

You are under no obligation to proceed after receiving your ring sizer. Production only begins once full payment is received and your size is locked in.

Production Timeframes

Once production begins, your ring will be completed and dispatched within 2–8 weeks depending on current schedule and complexity. You will be notified of an estimated timeframe at the time of purchase.

Cancellations by the Customer

All sales are final. BLACK does not offer refunds under any circumstances.

If you wish to cancel before production has begun, you will receive a store credit to the full value of your payment redeemable against any available BLACK design.

If you wish to cancel after production has begun, no refund or store credit will be issued. Once work has commenced, materials have been allocated and hours invested - the piece is in progress and cannot be reversed.

Cancellations by BLACK

In the rare event that BLACK needs to cancel your order, you will be offered either a full refund or a store credit at your discretion. No further compensation will be provided.

Change of Mind

We encourage all customers to take their time before purchasing. Each BLACK ring is made once in a batch of five and never remade - your purchase is a considered decision and we treat it as one. Change of mind after production has begun is not grounds for a refund or credit.

WARRANTY, CARE & RETURNS

Craftsmanship Guarantee

Every BLACK ring carries a lifetime structural guarantee. If your ring snaps, splits, or breaks under normal wearing conditions, we will replace it.

To make a structural warranty claim, the physical ring must be returned to us for assessment. Upon confirmation of structural failure, you will receive a store credit to the full value of your original purchase. As each BLACK design is made in a batch of five and never remade, a like-for-like replacement cannot be guaranteed - your credit applies to any current available design.

Sizing

Before production begins on your ring, we send a complimentary ring sizer to ensure an accurate fit. Sizing is confirmed by the customer prior to manufacture. We do not offer resizing or exchanges on the basis of fit after production.

As-Is Policy

All BLACK rings are sold as-is. We do not offer repairs, modifications, or alterations of any kind. Surface wear, scratches, and patina acquired through wearing are characteristics of sterling silver and .925 pieces - they are not defects.

What Is Not Covered

The lifetime guarantee covers structural failure only. The following are not covered under any circumstance:

  • Lost or stolen rings

  • Surface scratches, dents, or patina

  • Damage caused by impact, chemicals, or misuse

  • Sizing issues confirmed after production

Care

Sterling silver and 9ct gold are durable materials built to last a lifetime with basic care. Keep your ring away from harsh chemicals including bleach, cleaning products, and chlorine. Remove before activities likely to cause impact damage. Store in a dry environment when not worn.
